SERVICE SCHEDULE FOR PRODUCT ANALYTICS (HEAP)

Unless otherwise defined in this Service Schedule for Product Analytics (this “Service Schedule”), capitalized terms will have the meaning given to them in the MSA. This Service Schedule shall be applicable to all Product Analytics offerings (also titled ‘Heap Platform’ or ‘Heap Connect’ (“Product Analytics Services”) licensed to Customer under an Order Form or via an online purchasing portal.

1. ADDITIONAL TERMS APPLICABLE TO PRODUCT ANALYTICS SERVICES

Solely for the purposes of Product Analytics Services (and no other CS Service) ordered under an Order Form or through an online purchasing portal, the Parties agree that:

1.1 If Customer becomes aware (or is made aware by Contentsquare) that Visitor’s Personal Data (other than the Permitted Personal Data) has been processed through the CS Service, then, without limiting any of the rights or remedies available to a Party under the Agreement or under applicable law, Customer shall delete any such Personal Data from the CS Service. Customer acknowledges and agrees that deletion of Personal Data pursuant to this Section may cause other Visitor Data processed through the use of the CS Service to be deleted in the process;

1.2 Visitor Data processed through the use of the Product Analytics Services shall be available for Customer's use for the duration of the relevant period as specified in the Order Form (“Access Period”). Contentsquare shall delete or anonymize Visitor Data by default no later than thirty-seven (37) months from its collection (“Retention Period”). The Access Period may in certain cases be extended for an additional cost, subject to the Parties signing an additional Order Form;

1.3 The details of personal data processing applicable to the Product Analytics Services shall be as set out in SCHEDULE 1.B - PRODUCT ANALYTICS (PA) DETAILS OF THE PROCESSING of the Contentsquare Data Processing Agreement (DPA).

2. ADDITIONAL USAGE LIMITATIONS APPLICABLE TO PRODUCT ANALYTICS SERVICES

2.1 Pricing for Server-Side Events. The Product Analytics Services purchased under an Order Form or via an online purchasing portal include 3,600,000 annual Server-Side Events. For any Server-Side Events in excess of 3,600,000, Customer will be charged the equivalent of one (1) Session for every thirty (30) Server-Side Events.  "Server Side Event" means an event sent to the Product Analytics Services via the platform’s server-side track APIs and tracking tools.

2.2 Events per Session. For months in which the average number of Events per Session exceeds 150 Events, Customer will be charged the equivalent of one (1) Session for every additional one hundred and fifty Events. “Event” means a single instance of activity - including but not limited to auto-captured Visitor interactions, custom actions or signals captured via the platform’s APIs, Visitor actions synced from third-party integrations - together with any related metadata.

3. ADDITIONAL TERMS FOR EXPERIENCE ANALYTICS EXTENSION FOR PRODUCT ANALYTICS

If Customer licenses ‘Experience Analytics Extension for Product Analytics’ under an Order Form (“DXAe”), the following terms will apply to Customer’s use of DXAe (and no other CS Service, including Product Analytics Services):

3.1 Where the Session limits set forth in the Order Form are exceeded during any given twelve (12)-month period of the Term, Contentsquare may deactivate data collection;

3.2 The details of personal data processing applicable to DXAe shall be as set out in SCHEDULE 1.A - EXPERIENCE ANALYTICS (DXA) DETAILS OF THE PROCESSING of the Contentsquare Data Processing Agreement (DPA);

3.3 The provisions of Section 1 and Section 2 above shall not apply to DXAe.

4. ADDITIONAL PRODUCT SPECIFIC SERVICE SCHEDULES REFERENCED

If Customer licenses Product Analytics Free or Product Analytics Growth under an Order Form or via an online purchasing portal, the Service Schedule for Free & Growth Plans will also apply to Customer’s use of Product Analytics Free or Product Analytics Growth.
